Introduction

Wilken Group Limited is the holding company for several wholly and partially owned companies based in East and Central Africa. Wilken Group is incorporated in Kenya and our registered office is at Wilken House, Wilson Airport.

Your privacy is important to us and this Privacy Statement explains:

  • The personal data we collect.

  • How we process it.

  • What purpose we purpose it for.

  • Who your personal data may be disclosed by us in the context of our relation.

  • Your rights pursuant to the Data Protection Act 2019, with respect to the processing of your personal data.

This Privacy Statement applies to our visitors who either physically visit our premises or our website, customers, suppliers, agents, employees and all our stakeholders.

Information we collect.

We collect the following personal data you provide directly to us, and information given by your organization, our business partners, or our suppliers.

Website Visitors

  1. When you contact us by email on our site you may give us your personal information such as your name, telephone number and email address

  2. When you contact us through our social media pages;

  3. We collect or receive technical information and information about your visit automatically, such as online usage and log data when you visit or use our websites or other online Services. This information may be collected by way of Cookies. Should you consent to the use of cookies, we may receive:

    • Information on the device used to access our website or other online Services

    • Information about your location derived from your IP address if you are on a computer, or your mobile device’s more precise geolocation information.

    • Information about how you interact with and access our website or other online services.

Directly from you as a customer or contractor

If you contact us by telephone, electronic messaging or email or visit our premises physically in relation to our services, or if we contact you following contact of another nature, we will collect from you a range of information relating to you, including:

  • Contact Details: Name, Address, Telephone/Mobile number(s), Email and Date of Birth

  • Financial information: Bank account details, payment card details, details about payments to or from you and other details of products and services you have obtained through us.

  • Identification Details: Passport details and/or ID, Nationality

Any other relevant information that you choose to provide us with only for the necessary purpose.

This information is retained securely within our registered office. We may forward essential information such as passport details to the relevant authorities for our Air Charter services.

Accessing our Premises

When you visit our premises, Wilken collects data through the CCTV system in form of images. No audio is recorded.

The data collected by the CCTV footage is for the following purposes:

  • To identify and prevent crime within the business premises.

  • To protect our employees, visitors and property.

Appropriate signs are displayed to ensure customers, clients and other visitors are aware they are entering an area covered by CCTV.

From publicly available sources including:

  • Identity and contact data from the Government of Kenya’s e-citizen and Integrated Population Registration Services platforms;

  • Identity and contact data from publicly available sources such as the Companies Registry and the Business Registration Service;

  • Social media- If you are a potential candidate for employment with Wilken, we may have received your personal data from third parties such as recruiters or external websites.

  • Directly from an individual;

By choosing to interact with us in any way specified the section above, you will be doing so with full knowledge and consent that we will collect and process your personal data. By consenting, you allow Us to collect, process, store, disclose and transfer your data as provided for under the Data Protection Act and the regulations thereto.

How we share your Personal Data

We may share the personal information we collect or receive from you or about you as set out in this Policy or set out at the point when the Personal Data is collected.

  • With other companies and subsidiaries within the Wilken Group for processing your personal data in accordance with the purposes.

  • Personal data may also be shared with Wilkens trusted partners and third parties, to achieve the purposes. We will ensure that appropriate contractual safeguards are implemented to ensure protection of your personal data when disclosing it to a third party.

  • Where there is a legal requirement to disclose your Personal Data, we may do so in connection with a request from a government authority, court or tribunal proceeding, to prevent loss of life or injury, or to protect our rights or property. As far as it is possible and practical to do so, we will disclose to you the nature of the legal requirement.

Where we store your Personal Data

The appropriate security measures have been put in place to prevent your personal data from being accidentally lost, used, or accessed in an unauthorised way, altered or disclosed.

Data Retention

The Organisation retains your Personal Data for as long as it is necessary to conduct our business and to comply with our legal obligations. When we no longer need Personal Data, we will remove it from our systems and/or take steps to anonymize it.

We may however retain your personal data for a longer period if the retention is:

  • required or authorized by law.

  • reasonably necessary for a lawful purpose.

  • authorized or consented by you.

  • necessary for the purpose of responding to a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

  • for historical, statistical, journalistic, literature and art or research purposes.

Your Rights

Pursuant to the DPA, you may have the following rights:

  • The right to be informed;

  • The right access your personal data in our custody;

  • The right to object to the processing of all or part of your personal data;

  • The right to correction of false or misleading data; and

  • The right deletion of false or misleading data about you.

Changes to This Privacy Policy

From time to time, we may update this Data Protection Policy and the "Effective Date" above will change. Ensure you review it periodically and if there are significant changes to Wilken Group Data practices, we will provide an update online where appropriate.
